Terms of service

Last updated 22 October 2026

The agreement between [Company legal name] and the organization using Ortam. Whoever accepts it confirms they can bind that organization. Ortam is for businesses only.

Private beta

Features, limits and prices can change, and there is no uptime commitment. Changes apply going forward, never to a command or start we already accepted. We can end the beta with [notice period] notice.

Your account

You are responsible for all use of your keys, including by your users and agents, and for following the terms of any provider account you connect. Keep keys secret, revoke any you think is exposed, and tell us at once if your account is compromised.

Acceptable use

Don’t use Ortam to:

  • break the law or infringe anyone’s rights
  • attack, scan or probe systems you aren’t authorized to test
  • send spam or run phishing
  • mine cryptocurrency
  • run open proxies or anonymization relays
  • get around the isolation between Sandboxes or reach other customers’ data

We may suspend a Sandbox that breaks these rules or endangers others. We tell you why and stop only what is needed.

Your data

You keep your rights in what you put in Ortam and must be allowed to put it there. You give us permission to store and process it only to run the service for you. Our data processing agreement, [DPA link], is part of these terms and covers personal data we process for you.

Saves are the recovery point: if hardware fails, changes after the last completed save can be lost, even writes Linux reported as complete. Saves are crash-consistent, so pause writes first if an application needs a clean state. Memory and running processes aren’t saved, and a deleted file stays in earlier saves.

Fees

Prices are on the pricing page, and the plan fee counts toward usage. Running time counts from when the VM is ready until it stops, or until the stop deadline we accepted if that comes first, rounded up once per start to the second. Failed starts and waits for hardware are free. Each start keeps the price it was accepted at. We invoice [billing cycle], payment is due within [payment term], and prices exclude tax.

If an invoice stays unpaid after a reminder, we may stop new starts. We won’t delete saved disks for non-payment without [notice period] written notice.

Ending the agreement

You can cancel at any time; usage until then is billed. We can end the agreement with [notice period] notice, or at once for a serious breach. Afterwards you can export your data for [export period], unless the law or a security investigation prevents it. Then we delete it, earlier saves included, within [deletion period].

Liability

During the beta the service is provided as is, without warranties beyond those the law requires. Neither side is liable for indirect or consequential losses. Our total liability for claims arising from the same or related events is capped at the fees you paid in the 12 months before the first event behind them. These limits don’t apply where the law forbids them, such as for intent or gross negligence.

Changes and governing law

We email changes [notice period] before they apply; if one is materially worse for you, you can leave first. [Governing law] governs these terms, and [Courts] have jurisdiction. Questions go to legal@ortam.dev.
